I think another instance of railways using private land is Calcutta circular railway, where the ownership of one particular stretch of the land vests with Calcutta Port Commissioners.

It was both! A gangmen was walking down the platform when I opened the shutter for 10 seconds. As he saw the loco coming he came nearer and stood there on the edge of the platform.
